Car Dealerships

Do you have a car dealership in another EU member state other than Germany, are you in possession of a valid VAT identification number and would you like to buy a vehicle tax-free from us in Germany?

In order for us to be able to offer you a tax-free sale, we have requirements both for your dealership and the business process. After explaining these requirements to you, we will describe how the tax-free purchase of a vehicle from us usually works.

Requirements

Please send us the following information and documents by e-mail:

  1. Your valid VAT ID number.
  2. The identity card or passport (copy) of the business owner, managing director or executive officer. If the ID does not contain the signature of the holder, in addition a copy of the passport or driver’s license.
  3. Company documents (for example business registration, excerpt from the commercial register), which are not older than 3 months and which contain at least the following information:

 

  • company name, legal form, business address,
  • date of foundation,
  • object of the company, that is, what is the focus of your company’s operations,
  • name of all authorized representatives.

 

If you do not have your own website where you present your vehicles, then please send us a link to an online automotive platform, such as mobile.de or Autoscout24, where you maintain an account and present your vehicles.

We will check your documents, your website or, if applicable, your vehicle inventory on an online automotive platform and tell you whether we can offer you a tax-free sale.

For car dealerships that were newly founded or that often change their registered office and/or authorized representatives within short intervals, or where we cannot comprehensibly recognize that they are selling vehicles, we generally reject a tax-free sale because we, as the seller bear the tax risk. In such cases, however, you always have the opportunity to buy the vehicle including the German VAT. In these cases, there is no tax refund!

If we have decided on a tax-free sale, the following must be paid attention to in the communication:

  1. Please also send us your contact details (telephone number, mobile number, website, e-mail address) together with the documents, so that we can always reach you. Ideally, you have an e-mail signature.
  2. If your dealership has its own website and therefore a domain (for example, www.abcd.at), the communication must always be made via this domain (for example, info@abcd.at or employee1@abcd.at).
  3. If you do not have your own domain and use instead freemail providers such as Gmail or Yahoo, then the communication must always be made via the same e-mail address.
  4. Please note that we always take the business address for postal consignments, which we also use for the invoice. If another address is required, this address must be derivable from the official company documents.

In the course of the transaction, you will receive from us the purchase agreement and various documents for countersignature. Please pay attention to the following:

  1. We always name the authorized signatory by name. This person has to personally sign the contract as well as the documents.
  2. When signing, make sure that it corresponds to the signature of the authorized signatory on his/her identity card or passport, which we have received in copy.
  3. If your dealership uses a stamp, then the contract and the documents must be marked with the company stamp.

If we decided on a tax-free sale, the sale remains tax-free, but that does not mean that we do not retain any security. Until we receive proof that the vehicle has arrived at your business address, the tax exemption is actually in limbo.

To minimize the tax risk, we require one of the following two security deposits:

  1. You pay a deposit in the amount of German VAT (currently 19 percent). Your advantage is that you receive the vehicle documents immediately.
  2. We keep the vehicle documents. You have a financial advantage because you do not have to pay the deposit in the amount of German VAT.

 

After the proper receipt of an Entry Certificate, we release the retained security deposit. This means that we either transfer the deposit to your business account or send you the vehicle documents with DHL Express.

For tax-free vehicle sales, we do not accept cash payments. Please note:

  • Payment must be made in full by bank transfer.
  • The account must belong to your dealership.
  • The account must be kept in the country where your dealership is based.
  • All transfer fees must be borne by you.

In principle, three groups are eligible for the pickup. Below we explain what is to be considered in which group.

  1. Pick-up personally by the business owner, managing director or executive officer: Please inform us in time, when you will arrive. In any case, please have your valid identity card or passport in original with you.
  2. Pick-up by another employee of your dealership: Please let us know in advance when your employee will arrive. Send us in advance the name, the address and a copy of the identity card of the employee authorized with the pick-up. We will put this information into a power of attorney and send it to you. You sign the power of attorney, provide it with your company stamp if applicable and send us the power of attorney by e-mail in due time before the pick-up. Your employee has his/her valid identity card or passport in original at hand. A handover is not possible if no power of attorney exists. Please note that your employee should have a local reference to your business address.
  3. Collection by a transport company: Please inform us in time, when and which transport company will pick up the vehicle on your behalf. Send us in advance the name and business address of the transport company. We will put this information into a power of attorney and send it to you. You sign the power of attorney, provide it with your company stamp if applicable and send us the power of attorney by e-mail in due time before the pick-up. A handover is not possible if no power of attorney exists.

If the vehicle has arrived at your business address, the following must be observed, depending on the type of pick-up:

  1. Pick-up by you or another employee of your dealership: You send us an e-mail and tell us on which day (date) the vehicle has reached your business address.
  2. Pick-up by a transport company: The transport company will give you your copy of the waybill (CMR). The CMR stipulates in field 24 that you confirm the receipt stating the date of receipt, with your signature and, if applicable, the company stamp. Please send us by e-mail the CMR with the information contained in field 24.

 

We will then send you a PDF file (Entry Certificate) that you should print out, fill in the marked areas and send back to us by e-mail. The properly filled out Entry Certificate is the final proof that the vehicle has reached your business address. Only after the receipt of the Entry Certificate we can grant you the security deposit.

Transportation with own propulsion

  1. You select a car through our website and contact us by phone or e-mail.
  2. Please send us your VAT ID number, your company documents and the identity card or passport copy of the business owner, managing director or executive officer.
  3. If you do not have your own website where you present your vehicles, then please send us a link to an online automotive platform, such as mobile.de or Autoscout24, where you maintain an account and present your vehicles.
  4. We immediately check your documents and your website and tell you whether we can sell the vehicle to your dealership tax-free.
  5. We advise you in advance and send you on request detailed images of the vehicle.
  6. We can reserve the car for you for a maximum of 24 hours.

YOUR ARRIVAL

  1. Visit us during our opening hours with or without a scheduled date.
  2. If you come by train, we will gladly pick you up from the main train station Butzbach. Please inform us about 30 minutes before your arrival.

VEHICLE VIEWING, SALE AND PAYMENT

  1. Details and questions will be discussed with you over a warm cup of tea or coffee.
  2. You can calmly view the one or more vehicles on our 14,000 square meter premises without a salesperson present.
  3. If you decide to buy the vehicle, you will go for a test drive.
  4. After a successful test drive, we mutually sign a contract of sale. The signature must be carried out by an authorized signatory of your dealership (business owner, managing director, executive officer). This can also happen via e-mail if the authorized signatory is not present in person and is represented by an employee.
  5. The sale takes place against retention of a security deposit tax-free.
  6. Payment is made exclusively by bank transfer from the business account of your dealership. The business account is kept in the same country where your dealership has its official place of business.

EXPORT PLATES

  1. After receipt of the full payment and shortly before the scheduled pick-up date, we apply for export plates. You can choose a time span of 15 or 30 days.
  2. At the same time, we prepare the vehicle for the handover.

HANDOVER

  1. On the agreed pick-up day, you (business owner, managing director, executive officer) or an employee of your dealership authorized by you will arrive one last time.
  2. If you come by train, we will gladly pick you up from the main train station Butzbach. Please inform us about 30 minutes before your arrival.
  3. If we have received the full payment by bank transfer from your business account, we will hand over the vehicle, two keys, the invoice and the payment confirmation to you. In addition, you will receive the export plates and the associated liability insurance from us.
  4. If a security deposit has been made monetarily, you will also receive the vehicle documents (vehicle registration certificate Part I and Part II, COC).
  5. If you have instructed an employee of your dealership to pick up the vehicle, we must also have a power of attorney prepared by us and signed by you, so that we can hand over the vehicle to your employee. This power of attorney must be received by e-mail by us before the handover.
  6. You can now start the journey home with your new vehicle.

REFUND OF THE SECURITY DEPOSIT

  1. You and your new vehicle arrived safely at your business address? Let us know by e-mail when this has happened (date of entry).
  2. We will send you a document (PDF file) called Entry Certificate. You fill in the marked areas and send us this document signed back by e-mail.
  3. Once we have received the Entry Certificate by e-mail, we will either send the vehicle documents via DHL Express to you or transfer the deposit to your business account, depending on the form of the security deposit.
In principle, a purchase can also be made with just a single visit. You should have already arrived in the morning. In addition, you should also have clarified with your bank in advance that you will call to place an urgent transfer by telephone. If the payment arrives on the same day, we can hand over to you the vehicle, the vehicle documents and the export plates on the same day. If you are represented by one of your employees, you must provide us with the signed sales contract and the power of attorney prior to the handover of the vehicle.

Transportation with a transport company

ASSIGNMENT OF A TRANSPORT COMPANY

  1. You assign a transport company to pick up your vehicle and give us its name and address. Also, tell us the scheduled pickup day.
  2. We will send you a power of attorney, which you will send us back signed. The signature must be carried out by an authorized signatory of your dealership (business owner, managing director, executive officer). Without a power of attorney, we cannot hand over the vehicle to anyone but you.
  3. In the meantime, we prepare the vehicle for pickup.

HANDOVER

  1. The transport company comes within our opening hours, ideally with advance notice.
  2. If we have received the full payment by bank transfer from your business account and we obtained the power of attorney by e-mail, we will hand over the vehicle to the transport company with one key.
  3. If you have made a monetary security deposit and wish that we hand over to the transport company everything that belongs to this business transaction, please note this in the power of attorney. Then we can hand over the second key, the invoice as well as the vehicle documents to the transport company. If this is not what you want, we will send you the documents and the second key immediately by DHL Express.
  4. The transport company delivers the vehicle to your business address.

REFUND OF THE SECURITY DEPOSIT

  1. The transport company has delivered the vehicle to your business address? Send us the waybill (CMR) by e-mail. Make sure that field 24 contains the arrival date, your company stamp, your signature or the signature of one of your employees.
  2. After receiving the CMR, we will send you a document (PDF file) called Entry Certificate. Fill in the marked areas and send us this document signed back by e-mail.
  3. Once we have received the Entry Certificate by e-mail, we will either send the vehicle documents via DHL Express to you or transfer the deposit to your business account, depending on the form of the security deposit.
In principle, a purchase can also be made without a visit. We will gladly send you detailed photos and describe you the condition of the vehicle. The entire contract processing is then done via e-mail. It is a B2B transaction.
